  1. THIS PROGRAM CONTAINS A LIMITED USE 
  2. DEMONSTRATION VERSION OF A 'WORK-IN-PROGRESS' 
  3. INTERACTIVE ENTERTAINMENT PRODUCT.  PLEASE READ 
  4. THE FOLLOWING CAREFULLY BEFORE USING THE 
  5. PROGRAM.

  7. LICENSE AGREEMENT

  9. This is a license agreement between you (either an individual or an 
  10. entity), the end user, and Virgin Interactive Entertainment, Inc. 
  11. ('Virgin').
  12. VIRGIN PRODUCT LICENSE
  13.  
  14. 1.  GRANT OF LICENSE.  This License Agreement ('License 
  15. Agreement') permits you to use one copy of this Software and 
  16. associated files (collectively 'Software') on any single computer 
  17. system.  
  18.  
  19. 2.  COPYRIGHT.  The Software is owned by Virgin or its suppliers 
  20. and is protected by the United States copyright laws and international 
  21. treaty provisions.  Virgin retains all rights not expressly granted.  
  22. Therefore, you must treat the Software like any other copyrighted 
  23. material (e.g. a book or musical recording) except that you may either 
  24. (a) make one copy of the Software solely for backup or archival 
  25. purposes, or (b) transfer the Software to a single hard disk provided 
  26. you keep the original solely for backup or archival purposes.  You may 
  27. not copy any written materials accompanying the Software.

  29. 3.   OTHER RESTRICTIONS.  This License Agreement is your proof 
  30. of license to exercise the rights granted herein and must be retained by 
  31. you.  You may not loan, sell, rent, lease, give, sublicense or otherwise 
  32. transfer the Software (or any copy).  Notwithstanding the foregoing, in 
  33. one case you may transfer your rights under this License Agreement on 
  34. a permanent basis provided you transfer this License Agreement, the 
  35. Software, and all accompanying written materials, retain no copies, and 
  36. the recipient agrees to the terms of this Agreement.  You may not 
  37. modify, adapt, translate, create derivative works, decompile, 
  38. disassemble, or otherwise reverse engineer or attempt to reverse 
  39. engineer or derive source code from, all or any portion of the Software 
  40. or anything incorporated therein or permit or encourage any third party 
  41. to do so.  If the Software is an update, any transfer must include the 
  42. update and all prior revisions.

  44. EXCLUSION OF WARRANTY

  46. USE THIS SOFTWARE AT YOUR OWN RISK!

  48. The Software consists of a preliminary release demonstration version 
  49. of an interactive entertainment product and is being provided to you 
  50. solely for your evaluation of upcoming product releases by Virgin.  
  51. The Software may contain significant and insignificant program errors, 
  52. including errors which cause the interruption of operation of your 
  53. computer system.  Additionally, the interactive entertainment products 
  54. displayed in the Software may undergo significant changes prior to 
  55. release of generally available final versions or may not be released at 
  56. all.  As a result, the Software contained therein are provided "AS IS" 
  57. and you assume the responsibility for determining the suitability of the 
  58. Software on your system and for results obtained.

  60. VIRGIN DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, 
  61. STATUTORY OR OTHERWISE, ARISING OUT OF OR 
  62. RELATING TO THE SOFTWARE, OR ANY USE THEREOF, 
  63. INCLUDING (WITHOUT LIMITATION) ANY WARRANTY 
  64. WHATSOEVER AS TO QUALITY, THE FITNESS FOR A 
  65. PARTICULAR USE OR THE MERCHANTABILITY OF THE 
  66. PROGRAMS.  VIRGIN DOES NOT WARRANT THAT THE  
  67. OPERATION OF THE SOFTWARE WILL BE WITHOUT DEFECT 
  68. OR ERROR OR WILL SATISFY THE REQUIREMENTS OF YOUR 
  69. COMPUTER SYSTEM.  VIRGIN SHALL IN NO EVENT BE 
  70. RESPONSIBLE FOR LOSSES OR DAMAGES OF ANY KIND 
  71. RESULTING FROM THE USE OF THE SOFTWARE, INCLUDING 
  72. (WITHOUT LIMITATION) ANY CONSEQUENTIAL, 
  73. INCIDENTAL, SPECIAL, DIRECT OR INDIRECT DAMAGES OR 
  74. ANY LIABILITY FOR EXPENSE OR DAMAGE CAUSED BY ANY 
  75. DEFICIENCY, DEFECT, ERROR OR MALFUNCTION OF THE 
  76. SOFTWARE, HOWEVER CAUSED, ON ANY THEORY OF 
  77. LIABILITY, INCLUDING (WITHOUT LIMITATION) PRODUCTS 
  78. LIABILITY AND TORT, EVEN IF VIRGIN KNOWS OR SHOULD 
  79. KNOW OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES.

  81. These limitations and exclusions shall apply notwithstanding any 
  82. failure of essential purpose of any limited remedy.  No dealer, 
  83. distributor or retailer of Virgin  is authorized to make any 
  84. modification or addition to this warranty.  Some 
  85. states/jurisdictions do not allow the exclusion or limitation of 
  86. warranties or liability for damages, and therefore the above 
  87. limitations and exclusions may not apply to you, and you may have 
  88. other rights which vary from state to state.

  90. U.S. GOVERNMENT RESTRICTED RIGHTS.  The Software and all 
  91. accompanying written materials are provided with RESTRICTED 
  92. RIGHTS.  Use, duplication, or disclosure by the Government is subject 
  93. to restrictions as set forth in Restricted Rights in Technical Data and 
  94. Computer Software Clause at FAR 52.227-7013(c)(1)(ii) or FAR
